Terms of Service

These Terms govern access to and use of Minex, operated by Swizz Digital Limited.

1. Company Information

2. Description of Service

Minex is a queue management and appointment scheduling platform that helps businesses manage walk ins, appointments, service counters, follow ups, and customer notifications.

The service may include dashboards, customer queue views, appointment scheduling, visitor updates, and related reporting or operational tools.

We may update, improve, or modify the service and its features from time to time.

3. Eligibility and Accounts

You may use Minex only if you can form a binding agreement under applicable law.

You agree to provide accurate account information and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Acceptable Use

You may not use Minex to violate any law, infringe the rights of others, distribute harmful or unlawful material, interfere with the platform, or attempt unauthorized access to accounts, systems, or data.

You may not use the service in a way that disrupts normal operation, overloads the platform, or harms other users or their customers.

We may investigate misuse and take action, including suspension or termination of accounts.

5. Customer and Visitor Data

Businesses using Minex may collect and store limited customer or visitor information through the platform, including names, phone numbers, email addresses where provided, appointment details, queue activity, and related operational records.

You are responsible for ensuring that you have a lawful basis and any required notices or permissions to collect and use that information.

As between you and Swizz Digital Limited, you remain responsible for the data you submit to the platform on behalf of your business.

6. Notifications

Minex may send service related notifications, including email notifications and push notifications, to support queue updates, appointment reminders, service progress, and operational alerts.

You are responsible for using notification features lawfully and for providing accurate recipient details.

7. Fees and Billing

Paid features, subscriptions, or custom plans may be offered under separate pricing terms presented at the time of purchase.

Unless stated otherwise, fees are non refundable except where required by law.

Failure to pay applicable fees may result in suspension, downgrade, or termination of service access.

8. Intellectual Property

Minex, including its software, interface design, branding, text, graphics, workflows, and related materials, is owned by or licensed to Swizz Digital Limited and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of the platform to you.

You may not copy, modify, distribute, reverse engineer, resell, or create derivative works from the service except as allowed by law or with our written permission.

9. Availability and Changes

We aim to keep Minex available and reliable, but we do not guarantee uninterrupted or error free operation.

The platform may be unavailable from time to time due to maintenance, updates, third party outages, security events, or causes outside our control.

We may add, remove, or change features in order to improve the service or meet legal, security, or operational requirements.

10. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, misuse the service, fail to pay applicable fees, create security or legal risk, or use the platform for abusive, fraudulent, or unlawful purposes.

You may stop using the service at any time.

Termination does not affect any rights or obligations that by their nature should continue after termination.

11. Data Retention and Deletion

We may retain account, operational, and backup data for a reasonable period where necessary for security, compliance, dispute resolution, fraud prevention, backup recovery, or legitimate business operations.

Where account deletion tools are available, deletion requests will be handled in accordance with our Privacy Policy and internal retention practices.

12. Disclaimers

Minex is provided on an as is and as available basis.

To the fullest extent permitted by law, Swizz Digital Limited disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non infringement.

We do not warrant that the service will meet every business need, operate without interruption, or be completely free of defects.

13. Limitation of Liability

To the fullest extent permitted by law, Swizz Digital Limited and its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising out of or related to your use of Minex.

Our total liability for claims arising out of or related to the service will not exceed the amount you paid to us for Minex during the twelve months immediately before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

14. Indemnity

You agree to indemnify and hold harmless Swizz Digital Limited, its affiliates, and their respective personnel from claims, liabilities, damages, losses, and expenses arising out of or related to your use of the service, your data, your breach of these Terms, or your violation of any law or third party rights.

15. Assignment

Swizz Digital Limited may transfer or assign these Terms and the operation of the Minex service to an affiliated company, successor entity, or newly formed company as part of a restructuring, merger, acquisition, or internal reorganization.

In such cases the successor entity will assume the rights and obligations of these Terms, and your continued use of the service after such transfer constitutes acceptance of the change in service operator.

16. Governing Law

These Terms are governed by the laws of Jamaica, without regard to conflict of law rules.

You agree that disputes arising out of or relating to these Terms or the use of Minex will be subject to the jurisdiction of the courts of Jamaica, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may update the date of publication on this page and may provide additional notice where appropriate.

Your continued use of Minex after updated Terms become effective means you accept the revised Terms.
